This AUP applies to the use of DroidRun' Services. Where this AUP uses terms that are defined in the General Terms and Conditions ("GTC"), those terms shall have the meaning ascribed to them in the GTC. DroidRun reserves the right to change this AUP in accordance with the GTC at Terms of Service.
1. What type of activity is prohibited?
User shall not use, and encourage or allow any other person or entity to use the Services in prohibited manners, including but not limited to the following:
- User must not configure or use the Contract Software in a way that violates terms and conditions, robots.txt instructions, or comparable technical or contractual access restrictions of third parties. The User must ensure the legal compliance of the respective access, automation, and data processing with any applicable laws, regulations, or agreements, in particular export control regulations.
- User must not upload personal data within the meaning of the GDPR to the Contract Software without sufficient legal basis and ensuring a sufficient level of data protection.
- User may not upload any material to the Contract Software that infringes the intellectual property rights or other rights of third parties, including but not limited to trademarks, copyrights, trade secrets, rights of publicity, or otherwise violating, infringing or misappropriating the rights of any third party.
- User may not misappropriate, reverse-engineer, copy, disassemble, decompile, extract source code, trade secrets, or know-how, including DroidRun models, algorithms or artificial intelligence systems, or otherwise misuse or manipulate the Contract Software or any part thereof.
- User may not upload any viruses, spam, trojan horses, worms or any other malicious, harmful, or deleterious programs or code, including prompt-based manipulation or scraping behaviors, to the Contract Software or the Services.
- User may not attempt to use the Contract Software in a manner that compromises, circumvents, or tests the vulnerability of any of DroidRun's technical safeguards or other security measures, including captcha circumvention, scraping against prohibition clauses/robots.txt, ticket bots, account farming, credential stuffing, or other use of malware as well as circumvention of IP blocking/geo-blocking/rate limits via proxy.
- User may not use the Contract Software in any manner that may subject DroidRun or any third party to liability, damages or danger, including by violations of app license terms, app store rules or anti-automation prohibitions.
- User shall not use the Contract Software improperly or allow it to be used improperly, and in particular shall not use or upload to the Contract Software any content that is illegal or immoral and/or such content that serves to incite hatred, hate speech, illicit deep fakes, or fake news, or incites criminal acts or glorifies or trivializes violence, is sexually offensive or pornographic, is capable of seriously endangering children or young people morally or impairing their well-being or may damage the reputation of DroidRun, and shall not refer to such content.
- Users may not substantially replicate any product or service offered by DroidRun, including the API itself. For the avoidance of doubt and subject to the foregoing, each party acknowledges that the other may independently develop and publish applications that may be similar to or compete with the other party's applications, provided that all use of the API and associated data complies with these GTC and applicable confidentiality obligations.
This list of prohibited uses is provided by way of example and should not be considered exhaustive.
2. Who is prohibited from using the Services?
Consumers within the meaning of Section 13 German Civil Code may not access or use the Contract Software.
